Terms & Conditions
1. The Booking
A booking is only confirmed once full payment has been received. Selecting a time slot holds it for a limited period; if payment is not completed within that window, the slot is released and your booking lapses. Confirmation is sent by email upon successful payment.
2. Cancellations & Refunds
You have the right to cancel your booking within 5 business days of making it and receive a full refund, in accordance with section 16 of the Consumer Protection Act 68 of 2008. To cancel within this period, contact us via email.
After the 5-business-day cooling-off period, bookings are non-refundable. No refund will be issued for cancellations due to change of mind, personal commitments, illness, or inclement weather. The only exceptions to this are cancellation by us (see section 4) and failure by us to deliver your images (see section 6).
3. Transfers
A booking may be transferred to a different available slot on a single occasion, at our sole discretion, subject to availability. Transfers are not guaranteed. To request a transfer, contact us via email as early as possible. No transfer will be processed within 48 hours of the original session time. A booking may be transferred to another person at our sole discretion.
4. Cancellation by Us
In the unlikely event that we must cancel or reschedule a session, we will notify you as soon as reasonably possible and offer either an alternative slot or a full refund. This is the only circumstance in which a refund will be issued.
5. Punctuality & Conduct
Sessions begin at the scheduled time. Late arrivals will result in a shortened session with no reduction in price. We reserve the right to end a session early if conduct is unsafe or disruptive.
6. Deliverables
The number of edited images delivered is as described in your chosen session package. Final images are delivered digitally within the timeframe communicated at the time of booking, or within 30 days of your session date if no specific timeframe is given. Raw or unedited files are not delivered. In the event that we are unable to deliver your images due to circumstances within our control, our maximum liability is a full refund of the amount paid for that session.
7. Copyright & Usage
Emma-Jane Harbour retains full copyright in all photographs produced. You are granted a non-exclusive, non-transferable licence for personal use only. We do not deliver raw or unedited files.
Where you have given explicit consent at the time of booking, we may use images from your session for our portfolio, website, social media, and online marketing purposes. This consent is entirely optional and does not affect your booking. You may withdraw consent at any time by contacting us via email.
8. Liability
Our liability is limited to the amount paid for the session. We are not liable for any indirect, consequential, or incidental loss arising from the booking or session.
9. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
Privacy Policy
This policy is provided in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA/POPI Act) of the Republic of South Africa.

What We Collect
We collect only the information necessary to process your booking:
- Name, email address, and phone number (booker)
- Gift recipient name, email, and phone (if booking as a gift)
- Any special requests you voluntarily provide
- Google account profile information (name and email) used to sign in
Why We Collect It
- To confirm and manage your booking
- To send transactional emails (booking confirmation, reminders)
- To contact you regarding changes or queries related to your session
- To notify gift recipients where you have requested this
We will not use your information for unsolicited marketing without your explicit consent.
Third-Party Processors
Your information is shared only with the following processors, each bound by their own privacy and security policies:
- Google — authentication (Google OAuth sign-in)
- PayFast — payment processing (we do not store card details)
- Resend — transactional email delivery
- Google Analytics — anonymous website usage analytics
- Cloudflare — hosting and infrastructure
- Xero — accounting and invoicing
We do not sell or share your personal information with any other third parties.
Data Retention
We retain your personal information for as long as is necessary to fulfil the purpose for which it was collected and to meet any legal obligations. Booking records are kept for a minimum of one year after the session date.
Security
We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, or misuse. Our systems are hosted on Cloudflare's infrastructure with encrypted connections (HTTPS).
Your Rights
Under POPIA, you have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate information
- Object to the processing of your personal information
- Request deletion of your information (subject to our legal retention obligations)
- Lodge a complaint with the Information Regulator of South Africa

Changes to This Policy
We may update this policy from time to time. The current version will always be available at this URL. Continued use of our booking system constitutes acceptance of any changes.
